Peeps licensing FAQ's
What is a Peeps License Agreement? It is the right to make, have made, use and
sell the Licensed Technology and to practice under the Patent Rights contained
in the agreement.
Who should purchase the license? Everyone who wants to make or sell items that
use the technology.
Can anyone purchase the Peeps License Agreement? No. Peeps has full authority to
allow or deny to whom they license.
What if someone makes or sells an item that uses the technology and they don't
have a Peeps License Agreement? Their item may be infringing a Peeps patent,
which would be unlawful.
What if the patents in question have not yet been issued? Peeps may not
have legal recourse until they issue.
So why should a merchant or manufacturer pay for a Peeps license if patents
covering it have not issued? They can certainly wait to see if and when the patents
will issue, but it may take years.
What if they decide to make or sell the item anyway, and purchase the license
after patents issue? They will be denied the right to purchase the license if
they have been using the technology without permission. In addition, Peeps may
sue them and everyone else involved for patent infringement.
Why would peeps deny them? Because those who have no respect for
intellectual property would not be fit business partners or
licensee for Peeps.
What are some other reasons Peeps may deny them? If their business causes harm
to humans or to animals.
How are the royalty rates determined? Peeps determines the rates; usually
lower than industry averages for similar goods.
Will royalty rates always be the same for the same license? No. All of the terms are
subject to change at any time.
Can terms be negotiated? No. Peeps will not negotiate individual agreements.
Are all Peeps licenses non-exclusive? No. Sometimes exclusive licenses are offered,
such as for toy and game licenses.
